1. Data Controller

The data controller for data collected through this website is:

Acqua Yachts S.r.l., a single-member company subject to the direction and coordination of MRS3 S.r.l. — Via Resuttana 360, 90146 Palermo, Italy — VAT IT07281420823 — REA 448760 — Share capital € 10,000.00 fully paid up.

Any request relating to personal data can be sent to privacy@digitalvessel.ai.

For data collected on board by the Digital Vessel platform, the controller depends on who holds the relationship with the owner or user: the boatbuilder or charter operator offering the service under its own brand, or Acqua Yachts where the contract is direct. In the first two cases, Acqua Yachts processes data on behalf of the boatbuilder or operator as a data processor, and the relevant privacy notice is the one they provide.

2. What data we collect

a) Data provided through the site's forms

Contact form: type of request, name, email, type of business and, if provided, company, role, number of boats, boat model and year, message.
Investors form: name, organisation, investor type if provided, email, note.
Any direct communication by email or other contact channels.

b) Website browsing data

The servers hosting the site automatically record certain technical data needed for its operation and security, such as IP address, browser type, date and time of access and pages requested. The site does not load resources from third-party servers.

c) Data collected by the Digital Vessel onboard system

Where Digital Vessel is fitted to a vessel, the system may collect, according to the configuration chosen for that vessel:

Position and navigation data.
Technical data from onboard systems: engines, batteries, tanks, sensors.
Events, alarms and maintenance data.
Usage data from the app and from authorised users' accounts.
For fleets: tasks, checklists and jobs logged by crew members.

This data is digitally signed at source to support its authenticity and integrity over time.

3. Purposes and legal basis

4. Crew and guest data

Some platform features may concern people other than the owner — in particular, for charter fleets, tasks and checklists logged by crew members and the accounts of authorised users. The controller of the service for that vessel — the boatbuilder, charter operator or owner, as the case may be — informs crew and guests that the system is on board.

Digital Vessel does not detect people's presence inside cabins.

5. Who we share data with

Depending on the permissions configured for the specific vessel, data may be accessible to:

the building yard, for support and maintenance;
authorised dealers and service centres, within their assigned scope;
crew members, for operational functions;
insurance brokers or insurers, only with the owner's explicit consent and within agreed limits;
providers processing data on the controller's behalf, as data processors: Fiber Telecom S.p.A., for hosting and cloud infrastructure; Google Workspace.

Data is not sold or passed to third parties for marketing purposes.

6. Where data is stored

Data is stored in Fiber Telecom S.p.A. data centres in Milan and Palermo and, where necessary, in other European Union countries. Data is not transferred outside the European Economic Area.

7. How long we keep data

Data is kept for the minimum time needed for the purposes for which it was collected, as follows:

8. Data subjects' rights

Every data subject has the right to access, rectify, erase, restrict, port and object to the processing of their data under Articles 15-22 of Regulation (EU) 2016/679 (GDPR), and to withdraw any consent given at any time. These rights are exercised by writing to privacy@digitalvessel.ai. For data processed by Acqua Yachts on behalf of a boatbuilder or charter operator, the request is forwarded to the relevant controller.

Data subjects may also lodge a complaint with the Italian Data Protection Authority, the Garante per la protezione dei dati personali (www.garanteprivacy.it), or with their local supervisory authority.

9. Data security

Acqua Yachts uses technical and organisational measures to protect data, including network isolation, access segmentation, encrypted communications and digital signing of data collected on board. Details of the security architecture are available in the technical documentation, on request.

10. Changes to this notice

This notice may be updated from time to time. The date of the last update appears at the top.

This English version is provided for convenience. In case of any discrepancy between language versions, the Italian version prevails.

Cookies are small text files that a website sends to the user's device, where they are stored and sent back to the same site on later visits.

Cookies used on this site

The digitalvessel.ai website does not use profiling, marketing or analytics cookies, and does not load resources from third-party servers such as fonts, scripts or embedded content. Any technical cookies strictly necessary for the site to work do not require the user's consent.

If the site adds analytics, live chat or marketing tools in future, this page will be updated with the list of cookies used, their purpose and duration, and a consent banner compliant with applicable rules will be introduced.

The name “Digital Vessel”, the logo, the text, images and content of this site are the property of Acqua Yachts S.r.l. and are protected under applicable intellectual property law. Reproduction, in whole or in part, is prohibited without written authorisation. Third-party trademarks mentioned on the site belong to their respective owners and are used only to indicate compatibility with Digital Vessel.

Nature of the site's content

The information on this site, including descriptions of features marked as “in development” or “in design”, is provided for information only and does not constitute a binding contractual offer. The product's actual features and availability may differ from what is described; only signed contractual agreements between the parties are binding.

Limitation of liability

Acqua Yachts takes care over the accuracy and currency of the site's content, but does not guarantee that it is free of errors or that the site will be available without interruption. To the extent permitted by law, Acqua Yachts is not liable for damage arising from use of the site or reliance on its content, nor for the content of any linked third-party sites.

Governing law and jurisdiction

This site and the relationship with its users are governed by Italian law. Any dispute is subject to the exclusive jurisdiction of the Court of Palermo, subject to any mandatory consumer-protection provisions.
